The webinar on Dispute Resolution in International Construction was part of a series of daily workshops on Alternative Dispute Resolutions (ADR). The webinar was jointly organized by the Vietnam International Arbitration Center (VIAC) and the Society of Construction Law – Vietnam (SCLVN) with the support of the Singapore International Arbitration Center. Phien Dich Vien by AKT was chosen as EV/VE interpreters.
According to VIAC, payment violation, performance progress violation, works quality violation and unilateral termination were the most common causes for the dispute to arise in the project. And 80% of enterprises in Vietnam had opted to negotiate as dispute resolutions. Other methods include mediation, arbitration, court proceedings, termination of the relationship, and “nothing”.
In the webinar, participants could learn about the resolution of construction disputes in the International Court of Arbitration (ICC), in Singapore International Arbitration Center (SIAC), and in Vietnam International Arbitration Center (VIAC). The webinar also detailed American and Australian perspectives on arbitration and other ADR methods, giving an overview of the international approach to this type of dispute.
